Shimkus plans bill to simplify language in auto insurance policies
HARRISBURG, May 29 – State Rep. Frank Andrews Shimkus, D-Lackawanna, is planning to introduce legislation that would simplify the language in automobile insurance policies to clearly state if a consumer is signing away their right to sue.
“Drivers ought to know exactly what they’re signing when they buy vehicle insurance,” Shimkus said. “Phrases like ‘full tort’ and ‘limited tort’ can be confusing. Let’s call it what it is – a full right to sue and a limited right to sue.”
The options of limited-tort and full-tort coverage went into effect as a result of Act 6 of 1990.
Limited-tort coverage offers motorists a savings on their premiums in exchange for giving up their right to sue for pain and suffering if they are injured in an accident. However, they can sue to recoup medical expenses, and there is an exception if the driver at fault was drunk.
With full-tort coverage, motorists retain unrestricted rights to bring suit against the negligent party.
