Pashinski reminds scrap metal dealers of law to curb thefts

HARRISBURG, July 8 – State Rep. Eddie Day Pashinski, D-Luzerne, wants to remind scrap metal dealers of the scrap metal law and he is urging dealers In Pennsylvania to alert authorities of suspected thefts.

Pashinski said a recent article in the Allentown Morning Call  about a scrap metal theft incident in the Lehigh Valley has prompted him to remind dealers that the scrap metal law is designed to better track stolen scrap metals from places like churches and cemeteries.

"I want citizens to spread the word that this law is in place in Pennsylvania with the hope that it may prevent the senseless thefts of veterans' markers and other historical artifacts," Pashinski said.

Pashinski is the author of Act 113 of 2008. Under the law, scrap processors and recycling facilities must maintain records on all transactions of more than $100 and keep those records for two years. The records must include a photocopy of the seller's driver's license, the license plate number of the seller's vehicle, a description of the material purchased, the weight of the material and amount paid for it.

The law prohibits scrap processors and recycling facility operators from purchasing certain materials other than from commercial sellers. Those materials include items that are often stolen and illegally sold to scrap processors, such as beer kegs and detached catalytic converters.

Pashinski said violators can be fined up to $2,500 for a summary offense, and a subsequent violation is a third-degree misdemeanor.
