Grucela bill would give surveyors recourse for nonpayment

 

HARRISBURG, March 13 – State Rep. Rich Grucela has introduced legislation that would allow a surveyor to secure payment for his or her services by placing a lien on the property he or she surveyed.

 

Grucela said surveyors often have no recourse when they remain unpaid for services they have provided.

 

The measure (H.B. 767) would allow surveyors to have a priority lien on property to which they have provided services, in much in the same way that contractors can have a priority lien to secure payment for services they provide to erect or repair a structure on property. 

 

“A professional who renders a service should be paid for that service,” Grucela said. “Surveyors provide a critical element to deciding land usage and its boundaries. Their expertise should be valued, and they should be provided with the same tools many other professionals have to do their jobs adequately.”

 

Many states currently allow surveyors to file liens, often known as "mechanical" liens.
