Cruz proposal to ban sale of expired food, other outdated goods approved by House

HARRISBURG, Oct. 29 – A proposal introduced by state Rep. Angel Cruz, D-Phila., that would ban the sale of outdated and expired food, nonprescription drugs and cosmetics in Pennsylvania was approved by the House Monday.

Due to the risk of illness and other negative effects for consumers, Cruz said individuals and businesses should be held accountable if they ignore expiration dates on foods and other products.

“Selling outdated goods, especially with regard to food, medicine, cosmetics and baby formula, could harm consumers who are entrusting store owners to sell them quality and fresh products,” Cruz said. “Expiration dates are on products for a reason and store owners should adhere to them.”

The proposal was amended into legislation (H.B. 523) introduced by one of Cruz’s colleagues from Philadelphia, state Rep. Rosita Youngblood, that would strengthen existing law regarding counterfeit consumer goods and services by increasing penalties for counterfeiting and expanding the definition of the crime.

Cruz said that removing outdated and expired goods, as well as cracking down on counterfeit products, is important to protecting public safety and ensuring that consumers are getting what they pay for.

“This is common-sense legislation that would protect many citizens in Pennsylvania,” Cruz said.
