Pennsylvania House passes Tiburcio bill to help PA’s breweries stay in business
Would upgrade the PA Malt Beverage Tax Credit program so smaller breweries can take full advantage

HARRISBURG, May 5 – The Pennsylvania House of Representatives today passed legislation introduced by state Rep. Ana T. Tiburcio, D-Lehigh, that would upgrade the PA Malt Beverage Tax Credit Program to better assist Pennsylvania’s craft beer industry. The legislation would extend the carryforward period of the malt beverage tax credit up to five years and permit tax credit recipients to sell their credits to other Pennsylvania breweries.
Tiburcio is co-sponsoring the bill with state Reps. Steve Samuelson, D-Northampton; Dan Deasy, D-Allegheny; and Rob Matzie, D-Beaver.
Tiburcio said she introduced H.B. 2340, which was passed by a strong bipartisan majority, to assist smaller breweries.
“I am thrilled the House voted for legislation that ensures our craft beer industry continues to thrive and empowers more small businesses to stay open,” said Tiburcio. “This bill is a game changer for small breweries. Modernizing the tax credit program ensures that we remain the second-ranked state in the craft beer industry. I am so proud to support our local breweries, which generate over $5 billion for the Commonwealth each year and are essential to our communities.”
“I am glad the House voted to make commonsense changes that will make a real difference for the craft beer industry and ensure more small breweries stay open,” said Deasy, majority chair of the PA House Liquor Control Committee. “Pennsylvania’s craft breweries have made investments to build something lasting, and this bill enhances the tax credit to better support that commitment.”
“Tax credits are an important way we can help small businesses thrive, but they need to be structured in a way that provides meaningful assistance,” said Matzie, who is chairman of the House Majority Caucus. “The malt beverage tax credit — which allows breweries to offset their state excise tax liability — works well for larger, established businesses but not as well for smaller breweries with lower excise tax liability, because the credit often expires before these businesses can take full advantage of it.
“By modifying the credit to extend its life and permitting recipients to sell their credits to other Pennsylvania breweries, we can help ensure that the credit benefits large and small breweries alike. As the original sponsor of this legislation, I was proud to support and assist Rep. Tiburcio in taking up the fight and getting this across the finish line.”
The malt beverage tax credit program allows breweries that invest in their facilities or equipment to claim a tax credit equal to the amount of capital expenditures they incur, up to a maximum of $200,000. Currently, these tax credits can be carried forward for just three years. Credits may not be sold to other Pennsylvania breweries.
The bill now moves to the state Senate for consideration.
